Welcome to AttendanceGM. By accessing or using our web and mobile applications, including www.attendancegm.com, you agree to comply with these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use AttendanceGM services.

These Terms govern your use of AttendanceGM, including all features, content, services, and contributions to the platform.

2. Definitions

  • "Service" or "Platform": AttendanceGM web and mobile applications.
  • "Organization": An entity (company, school, or institution) that manages users' attendance data through AttendanceGM.
  • "User": Any individual using AttendanceGM, including employees, HR staff, admins, or managers.
  • "Team Member" or "Contributor": Any person who contributes to AttendanceGM's development, design, or operations.
  • "Account": A registered profile used to access AttendanceGM.

3. Eligibility

You must be at least 13 years old to use AttendanceGM. By using the service, you represent and warrant that you meet this age requirement.

4. User Accounts and Organization Control

  • Users must provide accurate and complete information when registering.
  • Users are responsible for maintaining the confidentiality of their account credentials.
  • Organizations (admins, HR, or managers) control all user accounts within their account and can access, download, or delete user data at any time without requesting assistance from AttendanceGM.
  • AttendanceGM managers may intervene only in exceptional cases, such as violations of these Terms or legal obligations.

5. Use of Services

  • AttendanceGM provides QR code-based attendance tracking for organizations.
  • Users must not use the service for illegal, unauthorized, or harmful purposes.
  • Users and contributors may not interfere with or attempt to bypass the service's security or functionality.
  • Organizations are responsible for ensuring users comply with these Terms.

6. Ownership, IP Rights, and Contributions

AttendanceGM Owns the Platform

AttendanceGM solely owns all rights, title, and interest in and to the platform, including software, code, designs, logos, trademarks, and all related intellectual property.

Limited License

Organizations and users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for internal attendance management purposes.

Data Ownership

Users retain ownership of their personal information, but organizations grant AttendanceGM a limited license to process and use this information solely to operate the Service. Organizations retain full ownership and control of all user data within their account.

7. Payment and Billing

  • AttendanceGM may offer paid subscription plans or premium features.
  • Organizations agree to pay all fees associated with their chosen plan according to the payment schedule.
  • Fees are non-refundable unless otherwise stated.
  • AttendanceGM may update pricing or billing policies with prior notice posted on the website.
  • Failure to pay fees may result in suspension or termination of services until payment is received.

8. Privacy

Your use of AttendanceGM is governed by our Privacy Policy.

  • Sensitive data is encrypted both at rest and in transit.
  • Attendance records and databases are backed up daily and weekly using DigitalOcean's backup systems.
  • Organizations control user data and may export or delete it directly.

9. Third-Party Services

  • AttendanceGM may use third-party services such as ModemPay and DigitalOcean.
  • Users and organizations consent to such integrations.
  • AttendanceGM is not responsible for third-party practices; users and organizations should review their respective privacy policies and terms.

10. Limitation of Liability

AttendanceGM is provided "as is" without warranties of any kind. AttendanceGM is not liable for:

  • Data loss or inaccurate attendance records
  • Service downtime, interruptions, or errors
  • Unauthorized access resulting from users failing to secure their credentials
  • Indirect, incidental, or consequential damages

11. Indemnification

You agree to indemnify and hold harmless AttendanceGM, its managers, and affiliates from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

12. Termination

  • AttendanceGM may suspend or terminate accounts for violations of these Terms or legal obligations.
  • Organizations control the deletion of their users' accounts and data.
  • Termination of an organization account will result in deletion of all user data within that account according to retention and deletion policies.
  • Access rights of team members and contributors may be revoked immediately upon termination or removal from the team.

13. Changes to Terms

AttendanceGM may update these Terms periodically. Updates will be posted on the website with the revised date. Continued use of the service constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of The Gambia.
  • Any disputes arising from the use of AttendanceGM will be resolved in the courts of The Gambia or through alternative dispute resolution as agreed between the parties.
